Who is responsible for the processing of your data?

What kind of personal information does KIMIDORI collect?
KIMIDORI may collect the following personal information from users of the KIMIDORI website through the corresponding forms: name, email address, postal address, telephone number, date of birth, gender and credit card (PAN+CVV2) in compliance with PCI DSS standards or account number (provided by the customer in case of return) when the user visits the WEBSITE, registers, places an online order, contacts KIMIDORI or participates in KIMIDORI promotions or surveys.
In addition, KIMIDORI collects all information relating to your browsing on the WEBSITE and your interaction with the brand.
All personal data collected by KIMIDORI comes from the interested party, except for contact information that may be provided to us by friends or family:
- To send a gift voucher or other gift.
- To share the wish list.
For what purpose do we process personal data?
The personal data of the interested party will be processed for the following purposes as applicable:
- Manage and develop registration on the WEBSITE. Registration will involve the creation of profiles of the user's navigation on the WEBSITE. This profiling consists of the use of the client's personal data and information on their navigation such as the products viewed or added to the basket, the sections of the WEBSITE/visited, the location to evaluate their preferences and/or personal interests with the aim of offering them the contents of the WEBSITE, the offers, the services and the products appropriate to their profile.
- Manage and develop the online purchase. We use the customer's personal information to process and deliver their order, informing them by email and/or SMS of the status of their order.
- Manage and send information about exclusive promotions, latest news and personalized information adapted to the profile, interests and needs of the interested party as a customer via email, SMS or post. How long will we retain the data?
KIMIDORI will retain personal data only for as long as is reasonably necessary taking into account the needs to respond to queries or resolve problems, make improvements, activate its services and comply with the requirements imposed by applicable laws. This means that it may retain personal data for a reasonable period of time even after the data subject has stopped using KIMIDORI services or has stopped using the WEBSITE. After this period, personal data will be blocked from all KIMIDORI systems.
What legitimizes us to process data?
KIMIDORI has the following legitimate bases for processing personal data:
Execution of the contract
The legal basis for the processing of the personal data of the interested party that is collected is the execution of the sales contract. In this regard, the interested party is obliged to provide the data that are necessary for its execution. If you do not provide us with this data, the purchase and sale will not be possible.
Legal obligations
The management and issuance of the sales invoice is based on KIMIDORI's legal obligation in its relationship with customers.
Consent
In relation to the following purposes, the legal basis for the processing of the personal data of the interested party will be the consent of the same, if it has been given:

- Management of sending information on exclusive promotions, latest news and personalized information adapted to the profile of the interested party.

The withdrawal of consent for these treatments by the interested party will not condition the execution of the sales contract entered into between the latter and KIMIDORI.

In relation to the following purposes, the legal basis for the processing of the personal data of the interested party will be the legitimate interest of KIMIDORI:
- Profiling through browsing the WEB by a registered user, as well as by all those users who have provided us with their data for any other purpose.
- The creation of profiles for the purpose of sending information on exclusive promotions, the latest news and personalised information adapted to the profile of the interested party.
- Sending satisfaction surveys on products purchased or services used by KIMIDORI customers to request their opinion and be able to improve them.
Our legitimate interest is to ensure that our WEBSITE remains secure, as well as to help KIMIDORI understand the needs, expectations and level of satisfaction of users and, therefore, improve services, products and brands. All these actions are carried out in order to improve the level of customer satisfaction and ensure a unique browsing and purchasing experience.
To which recipients can we communicate the data?
KIMIDORI does not sell customer data to third parties under any circumstances.
How does kimidori protect personal data?
The WEB uses information security techniques such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorized access to data and ensuring their confidentiality. To achieve these ends, the user accepts that KIMIDORI obtains data for the purposes of the corresponding authentication of access controls.
Additionally, any transaction made through the WEBSITE is carried out through secure payment systems. Confidential payment data is transmitted directly and in encrypted form (SSL) to the corresponding entity.

These General Conditions of Use, Conditions of Sale and Privacy Policy regulate the use of the website www.kimidori.es (hereinafter "the Website"), of which CRAFTERS GLOBALS 2014 SL (hereinafter THE COMPANY) with CIF B90105685 and address at Calle José Laguillo 26, in Seville 41003 is the owner.
Through its website www.kimidori.es, THE COMPANY provides information about its products and offers the possibility of purchasing them. Due to the content and purpose of the Website, people who wish to benefit from its services must have the status of "Customer", which is acquired by completing the registration form and following the steps that THE COMPANY subsequently communicates via email. The status of Customer implies adherence to the Conditions of Use in the version published at the time of accessing the Website.
In any case, there are pages of the Website accessible to natural or legal persons who do not register or initiate a product purchase (hereinafter, "Users"). In this regard, Users who access these parts of the Website agree to be bound by the terms and conditions set forth in these General Conditions, to the extent that they may be applicable to them.
THE COMPANY wishes to inform its Clients and Users that it is directed exclusively to a public over 16 years of age and that the territory in which it accepts and distributes orders is that comprised of Spain and Portugal (hereinafter, the "Territory"). THE COMPANY does not ship orders abroad (except Portugal). If a user is interested in receiving an item outside the aforementioned territory, and always within the European Union, they should contact THE COMPANY through the form or by sending an email to hola@kimidori.es, we will study your request and inform you about it. Orders will not be shipped under any circumstances to territories outside the European Union.

Product information
The descriptions of the products displayed on the Website are based on the information provided by CRAFTERS GLOBALS 2014 SL suppliers. However, the information given about each product, as well as the photographs or videos relating to them and the trade names, brands or distinctive signs of any kind contained on THE COMPANY's website, are displayed on www.kimidori.es for guidance purposes.
Prices
All product prices indicated on the website include VAT and any other applicable taxes. However, these prices do not include the costs of shipping the products, which are detailed separately and must be accepted by the Customer.
In the case of the Canary Islands, Ceuta and Melilla, prices are shown exempt from VAT, since according to the law these Spanish regions, having their own taxes, are exempt from paying VAT. This only applies to individuals, never to companies or self-employed workers.
Availability
THE COMPANY informs the Client that the number of available units is kept up to date with the stock in the warehouse and the availability from our suppliers. Under no circumstances will THE COMPANY intentionally put more units on sale than it has available or that the supplier has reserved for it.
THE COMPANY will do everything possible to satisfy all its Clients' demand for the products. However, occasionally, and due to causes that are difficult for THE COMPANY to control, such as human errors or incidents in the computer systems, it is possible that the quantity finally supplied by the supplier differs from the order placed by THE COMPANY to satisfy the Clients' orders.
In the event that the product is not available after the order has been placed, the Customer will be informed by email of the total or partial cancellation of the order. Partial cancellation of the order due to lack of availability does not entitle the Customer to cancel the entire order. If, as a result of this cancellation, the Customer wishes to return the delivered product, he/she must follow the provisions of the Returns section.
Pay
The Customer agrees to pay at the time of placing the order. The initial price shown on the Website for each of the products offered will be added to the rates corresponding to the relevant shipping costs. In any case, these rates will be communicated to the Customer in advance before formalizing the purchase.
The ticket or proof of purchase corresponding to the purchase order will be available and can be viewed at www.kimidori.es in the "My account", "Orders" section.
The Customer must pay the amount corresponding to his order by credit or debit card (Visa, Mastercard, Visa Electron and/or other similar cards), transfer or deposit into an account at a Cajasur branch, Paypal or cash on delivery. The card used to make the payment must have a Spanish bank or savings bank as the issuing financial institution.
The Client must notify THE COMPANY of any improper or fraudulent charges on the card used for purchases, by email or telephone, as soon as possible so that THE COMPANY can take the appropriate action.
Security
THE COMPANY has the highest security measures commercially available in the sector. In addition, the payment process operates on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection so that the information is transmitted encrypted using 128-bit algorithms, which ensure that it is only intelligible to the Client's computer and the Website's computer. In this way, by using the SSL protocol, the following is guaranteed:
- That the Client is communicating its data to THE COMPANY's server center and not to any other that attempts to impersonate it.
- That data is transmitted encrypted between the Client and THE COMPANY's server center, preventing possible reading or manipulation by third parties.
Formalization of orders
Once the order has been placed, that is, with the acceptance of the Conditions of Use and confirmation of the purchase process, THE COMPANY will always send an email to the CUSTOMER confirming the details of the purchase made.
Order cancellation
THE COMPANY will accept order cancellations when requested before the order is shipped. To cancel the order, you must request it using the "Customer Service" form or by sending an email to hola@kimidori.es. Once the shipment has left our facilities, we will not be able to accept the cancellation, and the CUSTOMER must proceed as detailed in the "Returns" section.
Delivery times, place of delivery and losses
I. Delivery of the product
THE COMPANY undertakes to deliver the product in perfect condition to the address indicated by the Customer on the order form, which must in any case be within the Territory. In order to optimise delivery, we would appreciate the Customer indicating an address where the order can be delivered during normal business hours. The transport company will generally make a first delivery attempt during normal business hours, taking into account the time specifications provided by the CUSTOMER for the second delivery attempt if the first attempt has not been completed successfully.
THE COMPANY shall not be liable for errors caused in delivery when the delivery address entered by the Customer in the order form does not correspond to reality or has been omitted.
THE COMPANY informs the Client that it is possible that the same order may be divided into several deliveries.
II. Delivery Time
We will send orders via a courier company (in the case of the Peninsula and the Balearic Islands). The order placed by you will be delivered to you within a maximum of 48 working hours from when we confirm that we have sent your order. Although THE COMPANY's usual delivery time is usually between 24 and 48 hours from the date the order is sent. In the case of Ceuta, Melilla and the Canary Islands, orders are sent via Correos, and we do not have approximate delivery times, as these depend on the service offered by Correos in each case.
These delivery times are averages and therefore an estimate. They may therefore vary for logistical reasons or due to force majeure. In the event of delivery delays, THE COMPANY will inform its customers as soon as it becomes aware of them.
Each delivery is considered to have been made from the moment in which the transport company makes the product available to the Customer, which is materialized through the control system used by the transport company.
Delays in delivery will not be considered in cases where the order has been made available to the Customer by the transport company within the agreed period and has not been able to be delivered due to a cause attributable to the Customer, mainly the Customer's absence from his/her home or place of delivery. The transport company works with a GPS tracking system using the PDAs carried by the transporters, so, provided that there is proof through this system that the transporter has appeared at the customer's address within the contracted period of 24-48 working hours, the first delivery attempt will be considered to have been made.
Once the order leaves our warehouses, you will be sent an email notifying you that your order has been accepted and is being shipped.
For security reasons, THE COMPANY will not send any order to PO boxes or military bases, nor will it accept any order when it is not possible to identify the recipient of the order and their address.
These delivery times may vary on certain occasions due to special promotions, such as sales periods. In these cases, these special conditions will always be reported in the information section corresponding to the promotion.
III. Delivery Data, Non-Deliveries and Loss
If the Customer is absent at the time of delivery, the transport company will leave a receipt notifying that it has been at home, or will call the customer by telephone to arrange a delivery time. THE COMPANY contracts, as part of the courier delivery service, the performance of a series of follow-up actions, aimed at ensuring that delivery takes place.
If delivery has not been arranged after 7 working days from the order being dispatched, the Customer must contact THE COMPANY. If the Customer does not do so, after 10 working days from the order being dispatched, it will be returned to our warehouses and the Customer must pay the actual shipping and return costs to the origin of the goods, as well as any associated management costs. These shipping and return costs may be higher than those offered on our website, as the company is responsible for a large part of these shipping costs as a special promotion for customers. These shipping and return costs will also vary depending on the weight and dimensions of the order.
If the reason for the non-delivery is that the package was lost, our carrier will initiate an investigation. In these cases, the response times of our carriers usually range from one to three weeks.
In the case of shipments made via Correos, Kimidori is not responsible for any possible losses that may occur.
IV. Diligence in delivery
The Customer must check the good condition of the package before the carrier who, on behalf of THE COMPANY, carries out the delivery of the requested product, indicating on the delivery note any anomaly that may be detected in the packaging. If, subsequently, after inspecting the product, the Customer detects any incident such as a knock, breakage, signs of having been opened or any damage caused to it by shipping, the Customer undertakes to notify THE COMPANY by email as soon as possible, before the following 24 hours from delivery. From that moment on, incidents of this type will not be dealt with (only parts under warranty).
Return
All products purchased from THE COMPANY may be returned and refunded, provided that the Customer informs THE COMPANY of their intention to return the purchased product(s) within a maximum period of 14 calendar days from the date of delivery and that the rest of the conditions established in this section are met.
THE COMPANY will only accept returns that meet the following requirements:
- The product must be in the same condition as it was delivered and must retain its original packaging and labeling.
- The shipment must be made using the same box in which it was received to protect the product. In the event that the box in which it was delivered cannot be used, the Customer must return it in a protective box so that the product reaches THE COMPANY's warehouse with the maximum possible guarantees.
- A copy of the delivery note must be included in the package, which must also indicate the returned products and the reason for the return.
The CUSTOMER may return the product to the COMPANY by any means deemed appropriate, with the CUSTOMER always bearing the shipping costs of this return and the risk of loss of the package. If the reason for the return is attributable to THE COMPANY (the product is defective or incorrect with respect to what was requested in the order), the amount of the return will be refunded. If the reason is another (the products were delivered correctly), the cost of the return costs will be borne by the customer.
To proceed with a return, the following steps must be followed:
- Please inform us within 14 calendar days of receiving the product that you wish to return. Information can be provided via email to hola@kimidori.es or through the customer service form.
- THE COMPANY will inform the customer of the address to which the product must be sent.
- The customer must send it via a courier company of their choice. The return must be paid for by the customer.
- Please inform us of the courier company used, date and time of return.
Only in the event that the delivered product is defective or incorrect, THE COMPANY will also reimburse the Customer for the corresponding shipping costs. To do so, the CUSTOMER must send us by email a copy of the invoice for the shipping costs incurred to return the product. Without this invoice, we will not be able to refund the shipping costs, although we will be able to refund the amount of the product provided that the established conditions are met.
Partial returns and cancellations will result in partial refunds.
THE COMPANY will process the return order using the same system used for payment within 3 days of confirmation of arrival of the returned order at the warehouse. The application of the refund to the Customer's account or card will depend on the card and the issuing entity. The application period will be up to 7 days for debit cards and up to 30 days for credit cards.
In any case, all the necessary information for making a return is available to the CUSTOMER in the SHIPPING AND RETURNS CONDITIONS section. Please read this section carefully before proceeding to confirm your order.
Guarantee of the purchased products
THE COMPANY acts as a distributor for manufacturers who guarantee that the products offered for sale on www.kimidori.es function correctly and do not have any defects or hidden flaws that could make them dangerous or unsuitable for normal use.
The contractual guarantee offered is the one normally granted by the manufacturer. Once the Customer has received the product, he/she will have the instructions provided by the manufacturer in its box, sufficient for the correct use and installation of the product and all the information about the guarantee. No Customer may request a guarantee more extensive than that indicated therein.
THE COMPANY shall not be obliged to collect the damaged product and the Customer must contact the Manufacturer's After-Sales Service. In this regard, THE COMPANY shall take the actions aimed at providing the Customers who so request the contact details of said service and shall provide them with sufficient information to submit the relevant claims.
The warranty will lose its validity in the event of defects or damage caused by external factors, accidents, especially electrical accidents, wear and tear, installation and use not in accordance with the Manufacturer's instructions.
Products modified or repaired by the Customer or any other person not authorized by the Manufacturer are excluded from the warranty. The warranty does not apply to apparent defects and lack of conformity of the product, for which any claim must be made by the Customer in question within 7 days of delivery of the products. The warranty does not cover products damaged by improper use.
Intellectual and industrial property
THE COMPANY holds all rights over the content, design and source code of this website and, in particular, but not limited to, the photographs, images, texts, logos, designs, brands, trade names and data included on the website.
Clients and Users are advised that such rights are protected by current Spanish and international legislation relating to intellectual and industrial property.
Likewise, and without prejudice to the foregoing, the content of this Website is also considered to be a computer program, and therefore, all current Spanish and European Community regulations on the matter are also applicable to it.
The total or partial reproduction of this website, or any of its contents, is expressly prohibited without the express written permission of THE COMPANY.

- Failures or incidents that may occur in communications, deletions or incomplete transmissions, such that it is not guaranteed that the services of the Website are constantly operational.
- Errors or damages caused to the website due to inefficient and bad faith use of the service by the Client.

- In any case, THE COMPANY undertakes to resolve any problems that may arise and to offer all necessary support to the Client to reach a quick and satisfactory solution to the incident.
- Likewise, THE COMPANY has the right to carry out promotional campaigns during defined time intervals to promote the registration of new members in its service. THE COMPANY reserves the right to modify the conditions of application of the promotions, extend them by duly notifying them, or proceed to the exclusion of any of the participants of the promotion in the event of detecting any anomaly, abuse or unethical behavior in their participation.
